Terms of Service

By registering, purchasing hosting, or using the site, you are agreeing to the following Terms of Service. Vastitude also reserves the right to change and modify the Terms of Service at any time with or without client notification. It is up to the client to periodically check, ensure they are up to date familiar with the new Terms of Service. If any client does not agree with the new Terms of Service modifications, their service will be terminated.

ANYTIME MONEY BACK GUARANTEE

Vastitude provides an Anytime Money Back guarantee, subject to the following terms of service:

Non-Refundable Fees: Setup Fees, Client Area Credit, Add-ons, One-Time Payment Services and Vastitude Infinity membership fees.

Cancellations within 24-Hours: With the exception of any Non-Refundable fees, all other services are eligible for a full refund within 24-Hours.

Cancellations after 24-Hours: With the exception of any Non-Refundable fees, all other services are eligible for a pro-rated refund of un-used service after 24-Hours.

You may not request refund for more than 1 active service every 28-Days.
If your account is terminated due to a violation of the Terms of Service, a refund will not be provided.
Refunds after 24-Hours will be subject to Admin fees.
With the exception of Non-Refundable fees, full refunds after 24-Hours of used service will be issued at our sole discretion.
Contact management for any issues as they can most likely be solved.


100% UPTIME GUARANTEE

We try our best to ensure services are available 100% of the time. Sometimes, however, for a number of reasons, services may be unavailable to you. You acknowledge that on occasion, an event will occur causing services will be unavailable. We make no guarantee that our services will be uninterrupted. However, as part of a service we offer (Vastitude Edge), you can claim credits for the downtime.


PREMIUM SUPPORT GUARANTEE

Vastitude provides 24/7 technical support to our clients via our Support Ticket system. The following are our guidelines when providing support: Vastitude provides support related to your Vastitude server functioning. Vastitude, while cannot guarantee a resolution, will attempt to offer technical support for application specific issues such as application configuration, web or mail server configuration, or any other such issue at our own discretion.

PROHIBITED USES

Vastitude strictly prohibits the following uses of its network and services:

  • The distribution, sale, or hosting of any illegally obtained or cracked software, "warez," "nulled scripts," and any otherwise unauthorised software.
  • The unauthorised sale or distribution of copyrighted media.
  • Engaging in network activity that is malicious, disruptive, or otherwise meant to negatively impact the service of others.
  • Maintaining services or infrastructure for services intended to scam, steal from, coerce, or otherwise deceive users.
  • Sending unsolicited e-mail messages (SPAM) of any kind.
  • Hosting websites, services, or networks that facilitate the trade or sale of goods that are banned or illegal in the United Kingdom.
  • Hosting websites or other services that promote malicious activity, including content related to hate, racism, and militant groups.
  • Hosting Tor servers, relays, and exit nodes.
  • Hosting any service or content that violates the laws of the United Kingdom.

  • In addition, the following activities are strictly prohibited:

  • Circumventing national or geography-based laws through use of hosted services.
  • Hosting, participating in, or facilitating sports betting, illegal gambling, and other kinds of online gambling.
  • Hosting, participating in, or facilitating unlicensed online securities trading, including currency, options, and stock trading; or hosting,
  • participating in, or facilitating any forms of online securities trading that are prohibited by the UK, USA, or your country of residence.
  • Operation of illegal gambling and betting robots, daemons, or scripts.
  • Operation of illegal securities trading robots, daemons, and scripts.
  • Excessive burdens on our CPUs or other resources, including our support services. You understand that bandwidth, connection speeds and other similar indices of capacity are maximum numbers. Consistently reaching these capacity numbers may result our need to place restrictions on your use of the Services. You agree that we may place restrictions on your use of the Services or support services to the extent that they exceed the use of these resources by similarly situated customers.

  • SERVICE PAYMENT & CANCELLATION

    All charges are shown in GBP, USD or EUR. We accept Paypal and Stripe.

    Registration is required to open an account with Vastitude. In order to complete payment for services, Vastitude requires verification of contact details including legal name, contact address, email address, and phone number.

    Establishment of service is dependent upon Vastitude's receipt of payment for services. After the initial subscription payment, subsequent payments will be due on the anniversary date of service subscription, according to the billing cycle selected by the client. Although services are provided on a subscription model, all payments are made without contract for future payment terms, and clients are not obligated to renew services unless they wish to continue the usage of their hosting services.

    Services may be renewed at any time, at the discretion of the client, by accessing the Client Area's "My Invoices" section. Invoices for services will be generated and delivered to clients via email approximately 14 days before renewal payments are due, and may be paid at any time convenient for the client. Payment of automatically-generated invoices for future services will automatically extend the related services.

    All services provided by Vastitude must be paid for in advance of service delivery.

    All services provided by Vastitude are provided with distinct renewal and payment terms. Should clients fail to remit payments for additional periods of service after the initial billing period, the particular services with overdue payments will be suspended. Vastitude will permanently terminate client services and all hosted data any time after 5 days of non-payment (usually after 14 days of non-payment). Clients are encouraged to contact Vastitude Billing department to arrange alternate payment terms, if necessary to avoid account suspension or termination.

    Chargebacks
    In the event of a chargeback, returned payment, or another financial dispute affecting a payment made to Vastitude, the related client's account and all related services will be suspended immediately, including suspension of all hosted data and backups. The client's account will be assessed a £25 fee per returned payment. Service will be restored only upon verified remittance of all fees and overdue subscription payments. Chargebacks and returned payments will be considered a breach of the billing terms contained in this Terms of Service, and Vastitude reserves the right to immediately terminate all hosted data of a client upon notice of a returned payment.

    Cancellation
    A client may cancel their account at any time by contacting Vastitude via the Client Area. Requests for account cancellation will be processed by a Vastitude team member to ensure the integrity of our service.

    Upon billing cancellation, all hosted data and services will be immediately terminated, and Vastitude will cease to provide service or support for the client. It is the client's duty to make sure any active subscriptions are cancelled. Vastitude will not be held responsible for automated payments made via a subscription.

    Upon account cancellation, client will no longer be eligible for any benefits or guarantees provided by Vastitude.


    SERVICE BACKUPS

    For Clients with Auto Backups service, Vastitude will create a backup everyday at 6:00PM UK Time. Backups are kept for 7 days and can be obtained anytime by ticket request. Though Vastitude does keep backups, it is not always guaranteed to be available through ticket request. Client is responsible for their own data management. By subscribing to our website you agree to take appropriate backups and agree Vastitude cannot be held responsible for any data loss for the following: equipment failure, natural disaster, acts of God, or human error.


    ONE-TIME PAYMENT SERVICE

    One-Time Payment services are not eligible for a refund.

    By purchasing an One-Time Payment service, you agree to be opted out of Vastitude Edge (Anytime Money Back, 100% Uptime and Premium Support Guarantees).

    Clients with One-Time Payment services must go to the Activity Check page (here) and check-in their service within 7 days of the next check-in due date or a service termination will take place with no retrieval possible of the service or files/configurations.

    VASTITUDE INFINITY

    We reserve the right to accept or refuse membership in our discretion.
    We may send you email and other communications related to Infinity and your Infinity membership (regardless of any settings or preferences related to your Vastitude account).
    Vastitude may increase the price for this service effective the first day of a Renewal Term by giving notice to the client of the new fees at least thirty (30) days prior to the beginning of the Renewal Term, and if the client does not give a notice of non-renewal, the client shall be deemed to have accepted the new fee for that Renewal Term and any subsequent Renewal Terms (unless the fees are increased in the same manner for a subsequent Renewal Term).
    Infinity Members are not permitted to purchase for the purpose of resale.
    From time to time, Vastitude may choose in its sole discretion to add or remove Infinity membership benefits.


    ABUSE

    To report abuse, contact abuse@vastitude.net.

    Any abuse complaints regarding a service of yours will be forwarded to you and will require immediate attention. We may suspend your services until abuse reports have been resolved. If an abuse report is found in favor of the reporter, your services may be terminated.
